3. AI Assistant Terms of Use

3.1 Nature of AI Services

Our Site features AI-powered chatbot assistants and property search tools powered by third-party large language models and data sources. THE AI ASSISTANT AND PROPERTY INFORMATION ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. The AI assistant provides information about our services, answers questions about real estate solutions, and facilitates contact inquiries. Responses generated by the AI assistant are automated and may not always be accurate, complete, or appropriate. 3.2 Prohibited Uses of AI Assistant

You agree NOT to use the AI assistant for any of the following purposes:

• Malicious Activities: Attempting to exploit, manipulate, or abuse the AI system for harmful purposes
• Prompt Injection: Attempting to override, circumvent, or manipulate the AI's system instructions
• Automated Abuse: Using automated scripts, bots, or tools to spam or overload the AI service
• Data Harvesting: Attempting to extract, reverse engineer, or systematically collect data from the AI system
• Illegal Content: Requesting, generating, or sharing content that violates any applicable laws
• Harmful Content: Requesting generation of content intended to harm, harass, threaten, or defame any person or entity
• Intellectual Property Violations: Requesting generation of copyrighted material or content that infringes on third-party rights
• Misinformation: Deliberately attempting to train or manipulate the AI to generate false or misleading information

3.3 User Responsibility and Liability for AI Abuse

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH THE AI ASSISTANT. Realty Software Solutions reserves the right to:

• Monitor and log all AI assistant conversations for quality assurance and abuse prevention
• Immediately terminate access to the AI assistant for any user violating these Terms
• Report malicious activity to appropriate law enforcement authorities
• Pursue legal action and seek damages for any abuse causing harm to our systems, reputation, or business
• Block IP addresses, implement rate limiting, or take other technical measures to prevent abuse

You agree to indemnify and hold harmless Realty Software Solutions from any claims, damages, losses, or expenses (including attorney fees) arising from your abuse or misuse of the AI assistant.

3.4 Data Sharing and Privacy in AI Conversations

DO NOT share sensitive, confidential, or personally identifiable information through the AI chatbot. This includes but is not limited to:

• Passwords, API keys, or authentication credentials
• Social Security numbers, credit card numbers, or financial account information
• Protected health information (PHI) or medical records
• Proprietary source code or trade secrets
• Any information subject to confidentiality agreements

AI conversations may be processed by third-party AI providers (Anthropic, OpenAI) and are subject to their privacy policies. Realty Software Solutions is not responsible for how third-party AI providers handle your data.

Unless otherwise agreed in a separate written agreement, custom software solutions developed for a client under a paid engagement become the property of the client upon full payment. Realty Software Solutions retains all rights to pre-existing intellectual property, proprietary AI algorithms, tools, frameworks, and code libraries.

6.3 User-Submitted Content

By submitting information through contact forms, AI chat, or property searches, you grant Realty Software Solutions a perpetual, worldwide, royalty-free license to use, reproduce, and analyze such content for business purposes, including improving our AI systems and services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

REALTY SOFTWARE SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE FEES PAID BY YOU TO REALTY SOFTWARE SOLUTIONS FOR SERVICES THAT GAVE RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.

REALTY SOFTWARE SOLUTIONS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SITE, AI ASSISTANT, OR PROPERTY INFORMATION. THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

8. Indemnification

You agree to indemnify, defend, and hold harmless Realty Software Solutions, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney fees) arising from:

• Your violation of these Terms
• Your abuse or misuse of the AI assistant, property search tools, or Site
• Your infringement of any third-party intellectual property or privacy rights
• Any false, misleading, or fraudulent information you provide

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction in such courts.
